Does ANY Competent Lawyer Believe RS And AK Are 100% Innocent? If So See These Questions

After 3 days and growing, unfortunately no sign that pro-innocence lawyers (if any) want to respond. Mr Simon? Mr Barnett? Ms Nancy Grace? (Well perhaps not you)
The Italian, US and UK lawyers who guide TJMK (of which I am one) look around and wonder: why are genuinely-convinced pro-Knox lawyers (if any) still not comprehensively answering all the open questions?
I contrast this with the various media talking heads who have offered drive-by comments without a really deep understanding of the facts of the case or Italian law.
In the law of all three countries, defense lawyers don’t need to KNOW either way whether their client is guilty or innocent. They don’t have to come out with a complete scenario to account for all the facts and point to innocence that would be the counterpart to my scenario (powerpoints - wait a few seconds to load) seemingly accounting for all the facts, which is still an unchallenged case for guilt.
But a comprehensive rebuttal would do the hard-pressed Sollecito and Knox factions a big favor, and provide a much-needed framework for the media (which is posting many incorrect legal claims), and make the Cassation appeal and the book-writing by Knox and Sollecito so much easier.
Consider the ups-and-downs of the defense legal teams on the case,
It was clear in 2008 that her lawyers absolutely didnt like Knox speaking out, offering different versions that between them made her look distinctly guilty. They didnt like the anti-Mignini campaign run from Seattle and they publicly said so - when Mr Mignini was attacked by a main speaker at an event at Salty’s they actually spoke up and publicly defended him.
In December 2008 NBC TV aired an excellent Dateline report. The main legal talking head, Ted Simon, explained that this was a really tough prosecution case to beat, and that whacking down individual points of evidence would not win the case in the public eye (justice would not be seen to be done) and that only a complete alternative explanation of the crime would do.
At trial in 2009 the defense teams did what they could with a torrent of facts and two unpredictable clients. The cross-examination of Amanda Knox on the stand mid-year in the context of Patrick Lumumba’s alleged framing must have seemed a real low-point for them, as she came across as rather flippant and chilling, and she said a number of things that all defense lawyers would probably prefer that she hadn’t.
Through the publication of Judge Massei’s report the defenses seem to have been faced with an uphill battle.
In 2011 an experienced criminal-case judge was initially appointed to preside over the first appeal. But quite suddenly, to the surprise of many in Italy and the alleged unhappiness of the judge himself, he was removed from the case, and Judge Hellman was appointed in his place.
Defence counsel would of course have had no role in that surprise change of lead judges for the first appeal, but from Day One of the appeal (spaced out to one session a week by Judge Hellman to suit one of them) the defenses seemed much happier.
The prosecution were now on occasion publicly hinting that they were now stuck with the uphill battle. The defenses now seemed the side energized and confident. But please note these three things which suggest that they knew they were not all-powerful.
- 1) They appealed on very narrow grounds, essentially on some witness testimony and a small part of the forensic evidence, and they kept well away from the multiple alibis, mobile phones and computers, and forensic evidence in the hallway, bathroom, and Filomena’s room.
2) They never argued that Rudy Guede was the lone-wolf killer in the case (the surprise preference in his report of Judge Hellman) and even put their own witnesses Alessi and Aviello on the stand to in effect try to prove otherwise.
3) Knox legal advisor Ted Simon was reduced to arguing on TV that there was no evidence of Knox and Sollecito IN the bedroom, while never accounting for the mishmash of alibis or all the mixed-blood and footprint evidence just outside the door.
As Dr Galati’s appeal and public opinion in the three countries are showing, the defences may have mostly won the second battle, with Judge Hellman’s interim verdict and sentence (Knox was still sentenced to three years), but they seem to be falling far short of winning the war for the two clients.
Now the defences again face an uphill battle.
So here we go. An opportunity for any good pro-innocence lawyer to help to win the war for Knox and Sollecito. Forget the forensics for now. I offer these several dozen questions for you and/or Amanda Knox which, truthfully answered, might put many concerns to bed.
I will be happy to post here any real attempt at answering all of these questions by any qualified lawyer who is thoroughly on top of the case - or of course any attempt by Amanda Knox herself.
1. Why did you not mention the 16 second 12.07 phonecall to Meredith’s English phone on the 2nd November in your e-mail? When explaining why you made this call, please also explain why it was to the English phone rather than Meredith’s Italian phone which you knew Meredith used for local calls?
2. Why did you not mention this call when you phoned Filomena immediately afterwards?
3. Why did you make so little effort to contact Meredith again after being told by Filomena to do so. Remember the logged 3 and 4 second phone calls?
4. Why did you tell Filomena that you had already phoned the police when neither you, nor Raffaele, had.
5. Can you and will you explain the contradiction between your panic at the cottage (as described in the e-mail) and the testimony of all the witnesses who subsequently arrived that you appeared calm, detached and initially unconcerned as to your friend’s whereabouts or safety?
6. Why did you tell the postal police that Meredith often locked her bedroom door, even when it came to taking a shower, when this was simply not true, as Filomena testified?
7. Can you and will you explain why you did not try either of Meredith’s phones at the cottage if you were indeed in such a panic about Meredith’s locked door?
8. Can you and will you explain how you knew that Meredith’s throat had been cut when you were not, according to the witnesses’s testimony, a witness to the scene in Meredith’s bedroom after the door had been kicked in and, with the exception of probably a postal police officer or the ambulance crew, no one had looked underneath the duvet covering the body when you were there?
9. What made you think that the body was in the cupboard (wardrobe) when it was in fact to the side of the wardrobe? Were you being flippant, stupid, or what, when you said that? Do you think it just a remarkable coincidence that the remark bears close comparison to the crime scene investigators conclusions, based on the blood at the scene, that Meredith had been shoved, on all fours, and head first, at the door of the wardrobe? She was then turned over on the floor and moved again. How did you know that there was any position prior to her final place of rest?
10. Will you ever be able to account for the 12.47 pm call to your mother in Seattle ( at 4.45 am Seattle time)? Do you remember this now because it was not mentioned in your e-mail nor were you able to remember it in your court testimony?
11. Why do you think Raffaele told the police ““ contrary to your own alibi that you had spent the whole time with Raffaele at his apartment ““ that you had gone out at 9 pm and did not return until 1 am?
12. Did you sleep through the music played for half an hour on Raffaele’s computer from 5.32 am?
13. Were you telling the truth when you told the court that you and Raffaele ate dinner some time between 9.15 and 11 pm? Can you not narrow it down a bit more? The water leak occurred, you said, whilst washing up dishes after dinner. Why then did Raffaele’s father say that Raffaele told him at 8.42 pm about the water leak whilst washing up dishes?
14. What was the problem about using the mop, rags, sponges etc already at Raffaele’s apartment, to clear up a water spill? Why was the mop from the girl’s cottage so essential and if it was, why not collect it immediately since it was just a short distance away?
15. Why, when you knew that you were going to Gubbio with Raffaele on the 2nd November, did you not take a change of clothing with you, if needed, when you left the cottage on the afternoon of the 1st?
16. Why did you need a shower at the cottage when you had already had one at Raffaele’s apartment the previous evening?
17. If you had needed one again why not have it at his apartment, in a heated apartment, before you set off, or on your return, rather than have a shower on a cold day, in a cold flat?
18. Why did you not notice the blood in the bathroom, and the bloody footprint on the bathmat, until after your shower? If the blood you then observed was already diluted and faded, how do you explain this?
19. Do not ignore your blood on the faucet. In your own testimony you said that there was no blood in the bathroom when you and Raffaele left the flat on the afternoon of the 1st. What is your considered take on this now? Did your ear piercings bleed when having that shower or drying afterwards? If so, why were you not perfectly clear about the matter in your e-mail? But then again you said that the blood was caked dry, didn’t you?
20. Why did Raffaele say that, on entering the flat with you, Filomena’s door was open and he saw the damage and mess inside, but you said, in your e-mail, that Filomena’s door was closed when you returned at 10.30 am? Did you subsequently look inside on that occasion, or not? It’s just that if you did, then why did you not mention the break in to Filomena prior to you and Raffaele returning to the cottage?
21. You are a creative writer so please explain. What is the point of the word “also” in the following extract from your e-mail? “Laura’s door was open which meant that she wasn’t at home, and Filomena’s door was also closed”.
22. In your trial testimony you mentioned shuffling along the corridor on the bathroom mat after your shower. From the bathroom to your room. Because there was no towel in the bathroom. You had left it in your bedroom. Then back again. Why is this not mentioned in your e-mail?
23. In your e-mail you stated that you changed for your shower in your bedroom, and then afterwards dressed in your bedroom. That makes sense. What you don’t explain is why, if you towelled and dressed in your bedroom, there was any need to shuffle back to the bathroom on the bathmat. Why not just carry it back?
24. But why, in the same testimony, did you then change your mind as to where you had undressed for your shower? Not in your bedroom - saying so was a mistake you said - but you did not say where. Some people might think, uncharitably, that your change of mind was necessary to incorporate the double bathmat shuffle.
25. Were there any things that you disliked about Meredith? Be honest because we know from her English friends and other sources that there were things that she disliked about you.
26. Why are pages missing from your diary for October?
27. Once again, and this time so that it makes some sense, please explain why you permitted the police, on your say so, to believe that poor Patrick Lumumba was involved in Meredith’s murder. Clearly, had you been at the cottage you would have known that he was not, and had you not been there you could not have known that he was.
There are actually over 200 open questions on this site, and I can think of others, but I consider these between them to be the core several dozen that relate to the quirks,contradictions, omissions and inconsistencies in Amanda Knox’s own account and behaviour. Answer all of these and in the public eye Amanda Knox really could be home free.

No, Book Agent Sharlene Martin, Your Client Raffaele Sollecito Really IS A Hot Potato

Los Angeles book agent Sharlene Martin posted this gung-ho comment on a Daily Telegraph thread (presently page seven) late Sunday night UK time.
I couldn’t be happier for Amanda Knox getting $4M for a book deal. What happened to her and Raffaele is a sin. BTW, I represent Raffaele for his book that we’re working on.
There is no restitution for wrongful conviction and both families incurred absorbent costs to help exonerate them so good for them if they help recoup the lost monies. They’ll never recoup the lost time of 4 years in prison.
She posted that at just about the same time we posted (post below) on the various hot-potato qualities of Raffaele Sollecito. Since then… no further word.
In terms of the book’s sale to a publisher she may not have much to worry about.
For this reason the deal is probably set in stone: Simon and Schuster are a fully owned subsidiary of CBS Broadcasting, which has gone to eye-popping lengths (post on this soon) to remain in bed with the Knox-Mellases.
The content of this ill-considered book might be a lot more problematic. Sharlene Martin might still believe that there are just a few open questions, easily accommodated to by the FOA talking points. In actual fact there are hundreds.
And the FOA have studiously stayed away from creating the alternate-universe scenario that Sollecito and Andrew Gumbel must now create, if they don’t want to end up as the laughing-stock of the western world.

Hmmm. Lotta questions to be answered in a hurry, if the book is to stir a wave of sympathy or outrage to stop the Italian Supreme Court punting the case back to Perugia to get it right this time around.
Above and below are images of the northern Italian city of Verona. It has the largest and best preserved intact Roman ampitheater in the world. It also has a very good university.
Possibly legitimately or possibly by way of strings pulled by his father, Raffaele Sollecito had gained a place in a graduate class at the university there for the Department of Computer Science’s masters degree in computer engineering.
In January Sollecitos father made several statements from Bari to the effect that Raffaele really was done with Amanda and dreams of visiting Seattle and would soon be headed for Verona to complete that postgraduate degree.
Rather suddenly, less than two months later, Raffaele is headed for Seattle, with his father and sister seemingly in hot and unexplained pursuit. Microsoft is suddenly mentioned as a firm which will interview him, masters degree or no masters.
So what happened? Well possible one explanation might be found in the comments area of every recent Italian report which allows them, which suggests that just about 100 percent of those posting don’t really like him.
That Italians dont really like him and are even inclined to physically take after him is also well illustrated in this story which we posted 18 months ago.
Sollecito was in the very modern solar-heated Terni prison for most of last year. He was moved back to Capanne this year just before the trial, amidst his loud complaints that Capanne lacks the internet connections for his computer-science homework.
Sollecito has just received word that he failed the virtual-reality entrance exam that he took at Verona University last March.
When he was being transported there in a police van for the exam, he was yelled at by an angry crowd when the van stopped at an autostrada rest-stop for what Americans call a bathroom break.
He was bundled back in, and the police van took off in a hurry. No bathroom break? That must have rattled his exam-taking composure, that is for sure.
Another possible explanation is that Sollecito is putting half a world between himself and Italy, because the Sollecito-Knox-Mellases realize that in light of Dr Galati’s formidable appeal that legally they are cooked.

Sollecito Ghost Writer Andrew Gumbel Reveals To MedaBistro How Ill-Informed He Is About His Client

Right now Sollecito ghost writer Andrew Gumbel is making loud, silly claims like many other writers who came upon the case and first fired from the hip.
And then “mysteriously” went silent and have not been heard from again. We have helped to edge back from the brink several dozen such reporters. Perhaps they ought to thank us - oh, actually in several instances they did.
Here on Media Bistro Andrew Gumbel gives a shoot-from-the-hip interview in which he seems to display a terrible batting average on the hard truths. The interview is being smartly ridiculed in the comments below it by among others TJMK’s own well-informed pro-Meredith campaigner Bucket Of Tea.
Here, to help set Mr Gumbel straight before it is too late, is our own informed commentary on what he said.
A: It’s a rule of thumb that prosecutors dictate media coverage in a criminal trial. They are the ones who bring the charges, and are either vindicated or successfully challenged in court; the texture and the substance of the defendants’ stories tend to get lost. And so it was here. The media coverage focused largely on the yes/no question of whether Amanda Knox and Raffaele Sollecito were guilty.
Untrue.
The mechanics of the case from the inside “” how they were interrogated, why they were prosecuted even after the most obvious perpetrator, Rudy Guede, was caught and convicted, the behind-the-scenes haggling between lawyers, defendants, expert witnesses, court officials and others “” have been revealed only in glimpses, if at all.
Untrue.
Both Amanda’s book and Raffaele’s book are sure to shed light on how and why this grotesque miscarriage of justice arose. I would venture to say Raffaele’s story is even more absorbing than Amanda’s, because it was his family which orchestrated the detective work that made it possible to dismantle the case against both of them piece by piece. It was a high-wire act from beginning to end, and it’s a thrilling tale.
Untrue.
Amanda and Raffaele can’t bring Meredith back, but they can give everyone the benefit of the truth. It’s an important story to tell. And after all they have gone through “” including the huge hit their families took to their reputations and their pocket books “” they certainly deserve both vindication and compensation….
Untrue.
Not only will the book leave no doubt about Raffaele’s innocence; everything Raffaele and his family have to tell, backed by previously unpublished documents in the case, suggests that his incarceration had almost nothing to do with the actual evidence but had another motivation entirely “” to be revealed when the book comes out…..
And untrue.Absurdly so.
Thirty plus judges who reviewed the case had no “other motivation entirely”. Please drop the smears of Italy and Italian justice. It isn’t becoming and there are already enough calunnia suits for felony defamation in the works.
And Sollecito’s family orchestrated no amazing detective work that showed that all the evidence was at fault. The defenses had every opportunity to do so in 2009 at trial and they did a truly terrible job. The Supreme Court already knows this so in what way exactly have they won?
In fact the main thing the Sollecito family is famous for right now is that they all face a trial in Bari. The charges are (1) illegally releasing video evidence to a TV network and (2) illegally attempting to subvert the police and prosecution by political means.
Now that’s true. Its seems two serious laws may have been broken. Andrew, read up about your Dear Clients here and especially here. They haven’t even attempted to “explain” all that as yet, and are almost certainly going to go down at trial.
And by the way, the evidence that the Sollecito family leaked to Italian TV? Video images of the naked body of Meredith. Very nice clients? You’ve been conned.

Mignini’s And Giuttari’s Florence Convictions Are Annulled: No Evidence, And No Jurisdiction

The ANSA news service is reporting that Giuliano Mignini’s and Michele Giuttari’s 2010 convictions have been annulled.
The Florence appeal court ruled scathingly that no evidence exists and also that the Florence trial court did not have jurisdiction. The case might be looked at again by the prosecutors in Turin or Genoa, which Mignini and Giuttari favor to get the spurious case against them more than just annulled. They’d like its root causes brought out. .
Mignini had caught the exact-same Florence prosecutor on tape, with a judge’s consent, bewailing the fact that the Monster of Florence cabal was tying his hands. That trial was simple a panicky attempt to get himself out from under which will hurt his career and the trail judge’s too.
It wasn’t Mignini who invented the Florence cabal (or satanic sect) notion, and he is suspicious of people (like Preston and Spezi) who work so hard to deny it. Many of the Italian Monster of Florence books also argue 180 degrees away from Preston. Hmmm. What hold does the Monster of Florence sect have over Preston? Is he a secret satanist?! The world really wants to know…
Mignin’s quoted remarks outside the appeal court make it sound like he would like to resume the investigation of why Dr Narducci died suspiciously in Lake Trasimeno. That had to be halted because the Florence prosecutor seized all the papers on the case.

US And UK Media: Make RS & AK Answer The HUNDREDS AND HUNDREDS Of Open Questions

It seems Judge Hellman has begun sweating.
Maybe Judge Hellman already sees as much of the Italian public and commentators do that he’ll have a REALLY tough time answering all the open questions in his December sentencing report as he is required to.
Constitutional requirement of Ministry of Justice never met?
That so many questions exist but are not generally even known about, especially in the US and UK, is because a key requirement of the usually very careful Italian justice system seems to have been (illegally) ignored.
The key requirement is built into the justice system by the Italian constitution. It is that trial and appeal sentencing reports MUST be made available to the maximum extent, so that the general public (usually only the Italian public) can readily check on the legitimacy of trial outcomes.
Italy is the only country in the world that has that public check and balance on trials. Under that requirement, if it existed in the US, Barry Scheck of the US’s Innocence Project would likely find that most of the travesties of justice his team uncovers would never have happened in the first place.
Here is how things are meant to work.
Back when the Micheli Report on the Rudy Guede sentence was released in January 2009 with Judge Micheli’s reasons for remitting Knox and Sollecito to trial it was released in THREE formats.
- 1) It was released digitally (in a Word Doc) to the media with the one requirement that it not be posted in full. We translated most of our copy and posted an extensive summary (scroll down) in English in four parts (three by Brian and one by Nikki) in September 2009.
2) It was released in printed document form by the Ministry of Justice in Rome and anyone in Italy could buy a copy.
3) It was also posted on the website of the Ministry of Justice in text and Acrobat document format. It appears that this Internet version was checked out by hundreds of thousands and quite possibly even by millions.
Now when the Ministry of Justice in Rome released the Massei sentencing report for Knox and Sollecito (links at top of this page) in March 2010, they released it in only ONE format.
The Ministry of Justice released it ONLY on paper, and it was obtainable ONLY by the press and by those in the general public who managed to figure out how to buy a copy of the book-sized document from the Ministry.
To our knowledge the Ministry of Justice never ever posted the required Internet version.
The effect of this serious and seemingly illegal shortfall by the Rome Ministry has been that even in Italy few people have ever read the Massei Report. The number of Italian readers might be only in the hundreds and at most in the low thousands. Way, way less than ever read Micheli.
As a result only very few people in Italy may have ever realized how powerful, logically complete and conclusive that report is. Probably few or no peers of the lay judges in Perugia have ever read it. The most important document in the entire case is essentially unread.
In August 2010 a PMF team finished translating the Massei Report and made available the Masssei report in English in Acrobat format on the PMF forum and on TJMK.
In June 2011 Skeptical Bystander and a PMF team posted a Massei summary in text on TJMK and PMF.
This English language version has been downloaded close to 30,000 times and there are many people in the US and UK who are very well informed on the conclusions. Every lawyer we know who has read the report has agreed that it arrived at the right conclusions. Many say and several do right here in these posts (scroll down) that the case would have been way more than enough for a US or UK conviction.
A slam dunk in effect. Evidence overkill.
But few of the busy people in the US and UK media have read the Massei Report and no one in the media to our knowledge has extensively analyzed or quoted from it. None of the books out so far go into the Massei Report in depth.
WHY did the Italian Ministry of Justice fail to fully distribute the Massei Report, and in particular not post it on their website? And is the Supreme Court of Cassation aware of this huge shortfall in its distribution?
This is such a serious mistake that our Italian lawyers believe that the Supreme Court or even the President of the Republic of Italy if he is petitioned could throw out the entire Hellman proceedings, verdict and sentence.
The hundreds and hundreds of open questions
Arising from the Massei Report are literally hundreds of questions for the released defendants and their teams. They have been around since early 2010. The defense teams and PR campaign have never ever tried to answer these questions, or for that matter to produce a convincing alternative scenario that hangs together implicating Guede but not Knox or Sollecito.
Here are four lists of the many, many outstanding questions.
- 1) Kermit posted this list of 150 questions for the prosecutors to put to Amanda Knox halfway through the trial in 2009. Still unanswered.
2) The TJMK Main Posters submitted several hundred questions to the Italian MP Rocco Girlanda in November 2010. Still unanswered.
3) Main Poster and trial lawyer SomeAlibi posted a list of 25 outstanding questions in this post in February 2011. Still unanswered.
4) And now the Daily Beast has reposted its own list of ten questions, none of which it reckons have yet been answered.
Here from the Daily Beast are those ten questions with the Beast’s annotations showing how they are STILL unanswered:
1. Why did you and Raffaele Sollecito turn off your cell phones at the same time the night of Nov. 1, 2007, and on again at the same time the next morning? You told the police that you and Raffaele slept late the morning of Nov. 2, 2007, but phone records show that you both turned your phones back on very early that morning. How could that be? This question was never addressed fully in the appellate process except when Giulia Bongiorno for Sollecito said that perhaps the cat stepped on the phone and turned it on. At that time the prosecutor Manuela Comodi quipped, “I’ve got a dog and he has never done that.”
2. Why were you bleeding? Your lawyers agree with the prosecution’s findings that at least one of the spots of Meredith’s blood found in the house where she was killed had your blood mixed with it. Your mother told me that you had your period. Your stepfather told others that your ear piercings were infected. Which was it? Even if this mixed blood drop is contentious in its genetic makeup (all blood or blood mixed with DNA), the appellate court was shown a picture of a drop of blood attributed entirely to Knox on the faucet.
3. Once you realized your mistake in blaming Patrick Lumumba for Meredith’s murder, why didn’t you tell the authorities? You told your mother that you felt bad about it, so why didn’t you alert an official so Patrick could be set free?
4. Why did you go with Raffaele to the police station on Nov. 5, 2007? You were not called in for questioning. Did you realize at that time that you were both under suspicion?
5. Why weren’t your and Raffaele’s fingerprints found in your house after the murder if the two of you had spent time there that morning and the day before? Only one half-print on a glass in the kitchen has been attributed to you, yet you have claimed that you took a shower there that morning. How did you spend so much time there and leave virtually no trace? Much of the crime scene has since been determined to have suffered from sloppy investigative work, meaning the absence of fingerprints in any room of the house may be due to that rather than any sort of cleanup.
6. Why did you take the mop and bucket from your house over to Raffaele’s house? You told the prosecutor during your testimony in June 2009 that you took the mop and bucket to his house to clean up a leak under his kitchen sink. But by your own testimony, the leak was minuscule and could have been easily cleaned up without it. What were you really doing with the mop?
7. What would you do differently if you had a chance to rewind the clock back to Nov. 3, 2007? Would you go to the memorial service for Meredith? Would you still have gone to the police station with Raffaele? Would you have left for Germany when your aunt asked you to?
8. What do you think happened the night Meredith was killed? You have professed your innocence. Who do you think killed her and under what circumstance? Your supporters say Rudy Guede was the lone killer. Do you agree? Or do you think there are still others out there who were involved in your roommate’s murder?
9. What do you really think of the Italian justice system? You told an Italian parliamentarian that you got a fair trial, and you even thanked the prosecutors for trying to solve the mystery of Meredith’s death, but your supporters at home in Seattle maintain that the Italian system is corrupt and unfair. In your appellate hearing you said you lost faith in justice and the police. Now that you are out, what do you really think of the system that has both convicted and acquitted you?
10. Is there anything you wish you would have said in court during your (initial) trial (in which you were convicted)? You talked about your vibrator and about how you did not want an assassin’s mask forced on you. But in your final appeal after the closing arguments on Dec. 4, 2010, why didn’t you say the words, “I did not kill Meredith Kercher”? Raffaele did when it was his turn to speak. Why didn’t you? You have said on many occasions during the appellate trial that you did not kill her and you have never hurt anyone. This question has been addressed with your denials. What about the rest?
Judge Hellman may be able to answer all of these unanswered questions AS HE MUST under Italian law in his sentencing report. He cannot simply address points defense raised about small parts of it. He must be able to explain the totality of the evidence or his report risks being thrown out by Cassation and a retrial at the first appeal level ordered.
Possibly Judge Hellman might be able to achieve this. But why do we seriously doubt it?

The Guardian Publishes A Negative Take On Italian Justice Rather Poorly Researched

Here are our most-read posts on first trials by Italian poster Nikki and the two appeals by Italian poster Commissario Montalbano and often-overlooked victims’ rights about Italian campaigner Barbara Benedettelli.
All explain better than Tobias Jones does the many hoops that prosecutors have to jump through for victims’ interests to come out ahead..
We can agree with Tobias Jones on this below - the elaborate, expensive and slow automatic first appeals complete with lay judges who don’t see the first pass of the evidence at first trial and often act as a wildcard in the process.
It’s one of the many failings of Italian justice that it never delivers conclusive, door-slamming certainty. What usually happens is that the door is left wide open to take the case to the next level, first to appeal and then to the cassazione, the supreme court. The score in the public imagination, at the moment, is simply one-all.
It’s always been that way. There’s barely one iconic crime from the post-war years that has persuaded the country that, yes, justice has been done: the murder of Pier Paolo Pasolini, the Ustica crash, the Bologna railway station bombing, the Piazza Fontana atrocity, the Monster of Florence murders, the murder of Luigi Calabresi, the “caso Cogne” “¦ none has ever been satisfactorily, convincingly resolved. Instead the country seems to split into innocentisti and colpevolisti (those who believe in the innocence or guilt of the accused) and the heated debates continue for decades.
But we’d agree less-so, at least from an American perspective, with the Italian uniqueness of this below.
Dietrologia ““ literally “behindery” or conspiracy-theorising ““ is a national pastime precisely because the courts don’t offer convincing verdicts. It allows every journalist, magistrate and barfly to try their hand. The result is that everyone with an active imagination has a go at explaining the truth behind the mystery, and inevitably the truth only gets further buried beneath so many excited explanations. The media plays an active role in keeping the circus going: in no other country are cronache nere ““ “black chronicles” ““ so much the mainstay of the evening news. There’s always a case on the go.
Tobias Jones should watch the urbane elegance of the Porta a Porta shows, which are reminiscent of human games of chess, and then visit the US and watch all the cable news channels devoting many hours a day to legal talking heads debating one another over high-profile crime cases. CNN and MSNBC could probably not survive without them (Casey Anthony was a godsend) and they go back to the OJ Simpson trial when it seemed half the country joined in.
He probably has a good point about subjudice (blackouts on court news in the UK) but there’d seem more chance of a wrong outcome driven by public opinion in the US with its elected judges and police chiefs and prosecutors angling for news exposure than in Italy. (Judge Michael Heavey is an elected judge.)
Local public opinion in the US is very much behind the high execution rate in several American states and the difficulties non-whites often have in getting off.

Million Dollar Campaign And American Media Come Under Intense Ridicule By An Influential Italian

A few hours from the verdict, America is in a trance over Baby Amanda - she is the girl from the golden west, an innocent victim of the wicked witches of the east, the ones wearing the robes of the Perugian judges - now awaiting the happy ending that everyone is expecting, which legions of correspondents and American TV cameras talk about and recount, as if the fate of the west depended upon her release from prison on appeal or on the confirmation of the guilty verdict

She is the “Girl from the Golden West”, the innocent victim of the wicked witches of the east, the ones who wear the robes of the judges from Perugia. It is a melodrama, sung, played and staged for an American audience which relishes it and avidly follows it like a soap opera or one of those legal thrillers which have made the fortune of of authors like Grisham, Turow and before them Earl Stanley Gardner.
Amanda like Puccini’s Minnie, is the snow-white, naive, extremely innocent girl imprisoned on the wild frontier of the Italian justice system, now awaiting the happy ending which everyone expects, which legions of correspondents and TV cameras tell of and which are preparing to recount as if the fate of the West depended on her release form prison on appeal or on the confirmation of her guilty verdict. And which networks like the ABC are already selling for $7.99 to be downloaded to I-pads and tablets.
Such a show of strength, such a shelling out of money on the part of “news organisations”, all now very careful down to the last cent in bad times, about a legal case the like of which has probably not been seen on the other side of the Atlantic since the trial of historic importance of Adolf Eichmann.
Yes, the monster of the SS, the brain and the accountant of the Jewish genocide. Live satellite coverage is expected for the imminent sentence to be pronounced by the Appeal Court and daily services will broadcast, especially those for the morning shows, those desperate housewives, for mothers who have children anxious to escape from the boredom of suburbia, the same old routine of high school parties to fly far away for new experiences, as Amanda dreamed.
The one whom the British tabloid press straight away stained with the nick-name given to her by her soccer team friends, in the football she played as a little girl: Foxy Knoxy, in which foxy means agile, cunning, escaping tackles and not for that “foxy” which, as in Fellini’s Amarcord evokes the arts of an enchantress and insatiable desires. Because while the USA was barracking for Knox, the English cousins were against her.
As well, other than those irresistible ingredients thrown into the cauldron of the morbidity which gains circulation and titillates the worst in every consumer of garbage TV with bombs and horror reconstructions, sex, blood, satanism, the woman with sacrificial lamb and the butcher, in the fury of the American media who throw themselves against this “court peopled with provincial lawyers” (still Rolling Stones which dedicated an extremely lengthy inquest) there is a great repressed and secret desire for vengeance.
There is the repressed rage against that Europe which is always ready with finger raised to accuse American justice of monstrous errors, of inexplicable acquittals (the O J Simpson case), of “puritanical” persecution as is said precisely on our shores, (Clinton crucified for oral sex), of horrible shows, like the arrest and the world-wide shame of Strauss Khan, or the details of the “panties cover-up” - inside or outside? - of the victim of Willy Kennedy Smith, raped on the beach of the Kennedy villa in Florida.
American justice which triumphantly boasts that it is the best in the world, but refuses to recognise that it has sent, and still sends, innocent people defended by useless bar-room lawyers to be executed.
Now swallow this, you supercilious and presumptuous Italians and Europeans. The frenzy of the specials about Amanda is pursued by the satellite nets which have to recuperate their expenses.
CNN, once the authoritative queen of the satellite, yesterday showed a long special on the four years of torments and injustice, with Amanda on show on the site, with her face in the shadow, her fresh-face and prison profile, the “girl next door”, quite different from the she-devil, the satanic female painted by the “baroque” closing arguments (here is another expression which appears in all the reports on the prosecutor, next to “mediaeval”, all that is missing are the Borgias and Machiavelli.)
On the site her face figures in double format in respect to the pallid and sinister image of the jihadist Anwar al-Awaki, killed yesterday, one of the infinite number of aspiring candidates for the succession of Osama Bin Laden. The number of listeners and hits motivates CNN: Amanda is in first place and is beating the terrible terrorists, as well as news on the economy and the stock market, disastrous again.
We are possibly on the way to a second recession, but there is no match, in the ratings, for that travesty, that parody of justice, put in place against the girl from the golden west, martyred in Perugia.
It is a thought that will print books, burn DVDs, work video-recorders to see once more the specials of CNN, Fox, ABC, CBS, MSNBC, local broadcasters, which have exalted as a hero, the blogger from Perugia who was sceptical from the first day. And the first network which succeeds in obtaining - or buying - the truth from Amanda, the “accidental murderer” who was dreaming of the view of Umbrian cypresses and who saw the prison bars of Italian justice, will be transported to the stars.
‘Is it true that you are always dreaming of sex?” the prison guards would ask the girl, according to her diaries, also printed greedily by Time. True, false, it doesn’t matter. Amanda is a victim, a woman, a little girl, and the verdict has already been issued here. An America, year in year out accused of being an executioner by anti-Americanism, even when its own symbols are collapsing, can finally call itself, this time, the victim. Today, here, we are all Amanda.Knox.

Seventeenth Appeal Session: Tough Day Ahead For Raffaele Sollecito’s Lawyers In The Minefield

Today it will be Giulia Bongiorno and Luca Maori for Raffaele Sollecito. Important considerations to bear in mind:
1) There are still all these open questions assembled by lawyer and main poster SomeAlibi and Sollecito chose not to address them on the stand.
2) The Supreme Court has definitively shut down the argument of a possible lone wolf perpetrator and Guede in court accused Sollecito to his face.
3) Attempts to show that Guede did it with others (Alessi’s testimony) or two or three others did it (Aviello) both descended into farce.
4) A staged attempt by Bongiorno using a staff member to try to scale the wall of the house to Filomena’s window descended into farce.
5) Sollecito referred to Amanda Knox as a liar in his third alibi and in effect implicated her by saying that on the night she was absent for four hours.
6) Solleito has still not explained his phone record or computer record or how his DNA could have got onto Meredith’s bra clasp.
7) Sollecito has still not explained the other physical evidence tying him to the scene: how his bloody footprint ended up on the bathroom mat.
His family faces a trial for releasing an evidence tape to a TV station, and for attempting to subvert justice by involving national politicians. And the family have still not rebutted Aviello’s charge that a bribe was waved at him to testify.
Not a pretty mess, by any means. Good luck, Bongiorno and Maori.

Rudy Guede For The First Time Sort Of Accuses Knox And Sollecito Face To Face

1. Potentially A Huge Day
Tension was really fraught. Everybody involved in the appeal and everybody watching in Italy knew this could be THE day.
Guede had recently lost his final Cassation appeal and in a very hard-line ruling Knox & Sollecito had also been associated with the crime.
He was at this appeal hearing as a prosecution witness, because he had written a letter to the prosecution heatedly denying the claims of a former cellmate, Alessi, that he had said Knox and Sollecito did not attack Meredith with him, another two had.
With seeming nothing to lose, Guede could both deny Alessi’s claim and definitively point the finger of blame at the pair, and thus all three would remain locked up for many years.
2. How The Day Actually Went
Despite a turbulent day in court this was not a shapeshifter event. The problem was that Guede was far too nervous to testify.
He is not normally nervous, but it is rumored that the name of Sollecito’s mafioso Uncle Rocco might have been been whispered in his ear.
So his prison letter was read out for him by the prosecution, and it did include this.
This splendid, marvelous girl was killed by Raffaele Sollecito and Amanda Knox.
Then Sollecito lawyer Bongiorno grew increasingly frustrated in attempting a cross-examination, and Guede ended up barely saying a word. The letter alone is rather diminished evidence.

Amanda Knox and her ex-boyfriend did kill Meredith Kercher, a man who was also convicted of the 21-year-old’s murder has told an appeal court.
After Rudy Guede confirmed he believed the US student killed her British housemate, Knox jumped to her feet saying she was “shocked and anguished”.
The hearing in Perugia is the first time that all three defendants have given evidence on the same day.
Knox, 23, and Raffaele Sollecito, 26, are appealing their convictions.
Child killerMiss Kercher, of Coulsdon, Surrey, was found with her throat cut at her Perugia flat after what prosecutors claimed was a sex game taken to the extreme.
Knox is serving a 26-year sentence for Miss Kercher’s murder while her Italian co-defendant and ex-boyfriend, Sollecito, was sentenced to 25 years.
Guede told the court that claims by a fellow prison inmate that he thought Knox and Sollecito were innocent were not true. He said he never made that claim to the inmate.
On 18 June, convicted child killer Mario Alessi told the appeal Guede had confided that Knox and Sollecito were innocent.
According to Alessi, Guede said he and a friend went to the house Miss Kercher shared with Knox with the intent of having sex with Miss Kercher and that when she refused, the scene turned violent and his unnamed accomplice slit her throat.
Drug-dealer Guede was jailed for 30 years for the sexual assault and murder of Miss Kercher after a separate fast-track trial. His sentence was reduced to 16 years on appeal.
Guede was in the witness stand as a letter he had written in response to Alessi’s claims was read to the court on Monday.
“This splendid, marvellous girl was killed by Raffaele Sollecito and Amanda Knox,” the letter said.
Guede has previously admitted being in the house at the time of the murder, but denies involvement in Miss Kercher’s death.
After cross-examination by the defence, Guede said he had always believed Sollecito and Knox were behind the murder.
“I’ve always said who was there in that house on that cursed night,” he told the court.
Knox stood up after Guede’s evidence and denied his claims.
“The only time that Rudy Guede, Raffaele and I were in the same space has been in court. I’m shocked and anguished.
“He knows we weren’t there and have nothing to do with it,” she said.
Sollecito said Guede was always talking “about a shadow that could be me and a voice that could be Amanda’s… we’ve been fighting shadows for four years. Our lives have been destroyed in a subtle and absurd way.”
Speaking before Monday’s hearing, Knox’s mother Edda Mellas told reporters she hoped that Guede would have the “integrity to stand up and tell the truth”.
She said her daughter was “always very anxious and nervous but I think she’s glad things are moving along. She feels things are going well,” but that it is, “hard to get too hopeful, especially after the first trial.”
Two other witnesses were called to counter claims made by another defence witness, a member of the Mafia named Luciano Aviello, who had told the court earlier this month that his brother - who is on the run - had killed Miss Kercher during a botched burglary.
The two witnesses - two inmates at the same prison as Aviello - testified that Aviello had said he had been contacted by Sollecito’s defence team to stir up confusion in the trial in exchange for money.
Witness Alexander Ilicet said Aviello had wanted the money for a sex-change operation.

As if the appeal wasn’t bizarre enough, two convicts were called by the prosecution as counter witnesses Monday to contradict several inmates called by the defense earlier this month.
They maintained they had overheard in prison conversations about a plot among other inmates to testify in exchange for money and benefits, such as reduced prison time.
The person they heard was arranging things, they said, was Sollecito’s attorney, Giulia Bongiorno, who heads up Italy’s parliamentary justice committee.
She forcefully denied the corruption accusations in the break afterwards and vowed to file charges and take legal action against her accusers.
One claim by the inmates was that Bongiorno offered a sex change operation to Luciano Aviello. It would be helpful if some of this if it exists emerged on tape. What possible reason would they have to lie?
5. And So To The Bottom Line
Along with Judge Hellman’s increasingly evident bias, and the smoke being blown over the DNA, and the Sollecitos and Bongiorno not (at least not yet) investigated by the judge for alleged witness bribes, not to mention Uncle Rocco’s power to alarm even by whispered mention of his name, the Knox and Sollecito defenses are down, but not yet for the count.
6. And A Footnote On The Kabuki Dance
This for the first time on Guede’s side (but not on Knox’s or Sollecito’s side) crosses a public boundary between the three.

Repeat of March 2010 Post: Guede Denounces Alessi, Blames Knox And Sollecito For Meredith’s Murder DRAFT

Guede will be required to testify on June 27. This is a repeat of Tiziano’s post of 12 March last year. At this point, Mario Alessi had made his claims to Sollecito’s lawyers at Viterbo Prison about Guede telling him he murdered Meredith with two others. And Rudy Guede had issued a heated hand-written rejection, denying this, ridiculing Alessi, and naming Knox and Sollecito as the murderers. Subsequent to this post, Prosecutors Mignini and Comodi travelled to Viterbo and interviewed both Alessi and Guede. This letter was Guede’s last major statement on the subject.

Rudy Guede was obviously provoked into putting his version of events out by the claim of Alessi (see video at bottom of this post) that he had a colleague with him on the night, and also by the finding of the judges in the Dispositivo that he was the prime instigator.

As usual in this beloved beautiful country of ours, there are many dishonest people given over to lying. And there are likewise those who give these people a voice without the slightest questioning of their consciences, whether it’s worth the trouble of giving space to certain conjectures.
In recent days the only things I have heard have been blasphemous insinuations about me; baseless gossip which has done nothing other than harrying, hither and thither, TV news channels, even though for reasonable people it is the pure invention of a wicked mind.
It must be said that all I have heard in recent days in the media, about what has been falsely stated by this foul being by the name of Mario Alessi, whose conscience is nothing but stinking garbage, are purely and simply the ravings of a sick and twisted mind, his ravings are the dreamed-up, untrue declarations of a monster who sullied himself with a frightful murder in which he took the life of an angelic little human being, as is known throughout Italy. This fellow, now, is telling lies about things that I never said to him and (other things) that I never said, things that don’t exist either in this world or the next.
To his ““ or rather their- rotten declarations, it’s my intention to put in black and white that I never confided in this disgusting creature, since moreover that I’ve got nothing to confess or anything else (to say), and everything that I had to say I have already said to the judges and I will go on shouting and fighting while I am still alive, until the truth itself and justice itself prevail over such lies, and even less did I speak one to one or together with other people or with other inmates about my trial affairs, and if I had ever had something to say, don’t you believe that I would have talked about it with my lawyers? Giving rise to and giving credit to what is a blasphemous statement made by a sick mind, to a monster who had no pity for a child.
With this latest scenario, which my lawyers, my family and I are now used to, from this latest person, the monster Alessi, I hope that Italians and the rest of the world realise that they are dealing with pigs, pigs which stink of the slime of falsehood, but which, not withstanding everything, go around showing their faces and suffocating people with their fetid lying.
Like their umpteenth scenario which does nothing more than give me the strength and the awareness to struggle more than ever, so that the truth that they want to hide is revealed for everyone to see.
As far as I’m concerned, (I have) the serenity and the calm of complete peace of mind, as a person who does not parade this unfair suffering, but who trusts in justice and in the good sense of Italians.
And finally I wish that sooner or later the judges will recognise my complete non-involvement in what was the horrible murder of the splendid, magnificent girl who was Meredith Kercher, by Raffaelle Sollecito and Amanda Knox.
